This is an appeal for erection of a rear addition on an existing semi-detached home.

The Zoning Classification for the property is RSA-5 (Single-Family Residential)
The application to the Department of Licenses and Inspections was REFUSED for the following reasons:

1) Non-conforming structure: Where a side wall does not meet a required side yard requirement, a. a horizontal extension of that wall into a front yard, rear yard or side yard is an increase of that specific nonconformity and is not permitted, and b. a horizontal extension of a side wall into a rear yard is permitted, provided the extension complies with applicable rear setback and open space requirements-a minimum side yard depth of 5 feet is required, whereas 4 feet is proposed.

2) Dimension Standards for Lower Density residential Districts: The depth of a rear yard is measured from the rearmost portion of the structure to the closest point of the rear lot line or to the nearest line of a street, shared driveway, easement, or alley-a minimum rear yard depth of 9 feet is required, whereas a rear yard depth of 5’6” is proposed.
